Check out the new video with the PDF CheckBox (or list) Cheat sheet (and video) for any general collection lawsuit defense. Trying to go as deep as I can for you in helping you along the way with your particular case.  Doing videos on defense against two Barclays Card lawsuits and then a debt buyer case (PRA) with fun review of data extensions and a false Affidavit. Hope it's fun somehow. I love catching debt collectors filing false paperwork which sadly, they get away with, 9 out of every 10 filings as most people don't fight back. That is the reason for this site. Hope they are easy to watch.  I will probably file the "fun" one first and drop it today. 

Let me know if anyone has a video or a thought in mind for future fun things to show. We are continuing our nuts and bolts approach in breaking stuff down with more Parker Law Library videos. If anyone has a definition they want me to do a brief video on, let me know. Thank you. Brian Parker

See our new front page as we continue to add to and change the site to make it better. Today we are dropping small videos for Parker's Law Library that we will add to as time permits or the members ask for definitions or procedures explained. So, if there is something you want defined or a procedure or litigation approach explained, I will respond with a quick video on it. Just dropped a unique one that has been requested a lot. I hesitated to do it as it is tough to sound anything but dry. "Suing a Debt Collector in Federal Court." Real case (as always) where the Defendants just were really wrong in what they did. Don't usually file Federal cases anymore as the bar is being raised higher all the time in kicking valid claim out. But this case cried out to me. See references to PRA v Green, SOL and lots of FDCPA, FCRA violations. Good reading for State Defense cases too.

I have a request for statement of damages and I don't know how to answer. In my counterclaim I stated the the company should owe me $5000 for my time and trouble of having to answer the original lawsuit against me. From what I looked up its states that I would have to submit a monetary list of damages. I'm not sure if I can sue for emotional distress as damages. Just totally unsure of how to answer please help!!!!!

So I had my pre-trial today. The attorney called me out to the hall like they do and asked what we were doing with the case, are we settling? I said if by settle you mean you drop your case and I’ll drop mine. He laughed and said no, that’s not going to happen. He said so are you saying your defense is it’s not my credit card? Did you get statements at your house? I said no idea, there’s been no documents submitted in this case. I said my defense is I do not owe LVNV. He said so you want proof they own it. I said yes. Where’s the assignments? Do they have the rights and representation to sue me? He goes, are you a paralegal? I said no. He said you just learned this? I said yes. Good for you. He said they said your responses were very well written, that’s unheard of. Then he said, do you know Brian Parker? I said yes. He said my secretary used to work for him. I like him. He’s on your side and helping you with this somehow. Made me smile. I guess I’m being a BPP. And we agreed to go to discovery. He also stated that would probably mean going to summary disposition as well. I said idk, I’ve got a pretty solid case. I was not a very good BPP in front of the judge though. The attorney stated we agreed to go to discovery. And I confirmed. I feel like I should’ve still stated my case for the record and still asked for dismissal but I was a little nervous I suppose. So we have a new date set for discovery and such for pre-trial still or something. So I’m guessing my next step is to file a request for discovery docs? I don’t have to do a motion… I need to figure that out and  work on that next. Judge said something about, if it’s filed on time as well. I don’t know if that was about the motion for summary disposition or what. Oh and the attorney was Eric Naslund.

Hello Mr. Parker, 

We filed a motion to set aside judgment on a lawsuit from Citibank represented by The Moore Law Group and debt collector, husband was never served with. We resided in NV; lawsuit was filed in CA. WE went to NV court and was told that since judgment had been domesticated to NV, we would have to fight it in NV. So, we did. submitted all documents we had showing we never got served and hearing on the motion was supposed to be today, but yesterday we got a "minute order" from the court denying our motion? 

We only fought it from NV because NV court clerk told us that's how it had to be done. Do we have to file the motion to vacate in CA or can we do something in NV?
