I don't see any threads on this and I'm not finding anything searching google. In the Bill of Sales, what is the difference between a Bill of Sale of Accounts and a Bill of Sale of Receivables? Anyone know the answer?

I also find it odd, that they name Exhibit A in every Bill of Sale. Like do they always use court evidence naming in their bill of sale or were all of these just now drafted, as no date with any of the signatures either. Just another observation I felt was odd.

Okay, it's 3 am and after diving into all of your latest material and picking through their mountain of paperwork, I am less stressed. I have a pile of problems with their own paperwork and I have a spreadsheet going of everything. Tomorrow I will draft and send out the responses they are requiring, and I will be jumping on your Live. I let the pile of their crap get the best of me, and if some are late or not, I'm still submitting it because they don't follow the rules either. I will have any questions I have left over ready for your Live. 

One issue, I've never seen addressed yet, is with their "computer file". It has resurgent right in the name from the very beginning of the initial sale from Credit One to MHC. That's odd right? Like why is it labeled that. That's a label resurgent would name their "file" once they received it, and file name is pushing it as there is no data extension naming it a file. Exhibit A is nothing. Spreadsheet of accts is exhibit 1 not exhibit A.

PARKER Makes sense! Thank you! Can't wait to see what they do with my discovery request. You've been nothing but excellent in this trial period of my life, literally. Thank you so much for what you do for people! And making it affordable for people who obviously are already struggling!

I just emailed them my discovery requests. Now I can prepare for the next steps! I'm hoping they are sick of me by now. They received my validation and cease and desist letter on April 3rd so they really only have 30 days to get these docs back to me right? Also, I'm not sure if this is anything, but I saved it just in case and found it funny... the original creditor on my two lawsuits with LVNV is Credit One (by my knowledge not what they have told me) and I just received a credit card offer in the mail from Credit One! I'm thinking to myself, if "I owe them", or whoever all this money, and they are having trouble collecting, why would they send me an offer.

So I had my pre-trial today. The attorney called me out to the hall like they do and asked what we were doing with the case, are we settling? I said if by settle you mean you drop your case and I’ll drop mine. He laughed and said no, that’s not going to happen. He said so are you saying your defense is it’s not my credit card? Did you get statements at your house? I said no idea, there’s been no documents submitted in this case. I said my defense is I do not owe LVNV. He said so you want proof they own it. I said yes. Where’s the assignments? Do they have the rights and representation to sue me? He goes, are you a paralegal? I said no. He said you just learned this? I said yes. Good for you. He said they said your responses were very well written, that’s unheard of. Then he said, do you know Brian Parker? I said yes. He said my secretary used to work for him. I like him. He’s on your side and helping you with this somehow. Made me smile. I guess I’m being a BPP. And we agreed to go to discovery. He also stated that would probably mean going to summary disposition as well. I said idk, I’ve got a pretty solid case. I was not a very good BPP in front of the judge though. The attorney stated we agreed to go to discovery. And I confirmed. I feel like I should’ve still stated my case for the record and still asked for dismissal but I was a little nervous I suppose. So we have a new date set for discovery and such for pre-trial still or something. So I’m guessing my next step is to file a request for discovery docs? I don’t have to do a motion… I need to figure that out and  work on that next. Judge said something about, if it’s filed on time as well. I don’t know if that was about the motion for summary disposition or what. Oh and the attorney was Eric Naslund.

LVNV lawsuit update! I've received their answers and affirmative defenses to my counterclaim. Just the same generic bullcrap with them denying things like, "you haven't provided any documents or proof." They did use the mini miranda on the documents this time, so I will be sending out a validation of debt letter today. And do I have to respond or do anything regarding their answers or do I just now wait for the pre-trial next week?

No they haven't used the mini miranda yet. And I don't answer the phone for those numbers anyway lol. But yeah. There were two LVNV cases in there today and they both settled with the lawyer out in the hall before the case was called. Tomorrow is 10 days since I sent the amendments and counterclaim and our pre-trial isn't until third, so I might send it again registered mail. Just a small oops I hope.
